Terms of Service

By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.

General

- I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
- Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service.)
- My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
- AI/NFT use is strictly prohibited. My work may not be used in Al datasets, engines, or minted as NFTs.
- No tracing allowed.
- Communication is important. If I do not receive a response within 1 week, I will proceed and deliver the artwork as is.
- You receive 3 free revisions (sketch stage only). Additional revisions cost 15€ each, paid before I continue. Please provide all feedback at the sketch stage.

Payments & Fees

- A 50% upfront payment is required to begin work. The remaining 50% is due before final delivery of the artwork.
- Payments to proposals should be paid fully within 2 weeks or will be declined.
- Complexity Fee is between 10€ - 100€ for all Commissions.

Revisions

- Revisions are only available during the sketch phase.
- Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.

Deadlines and Delivery

- Commissions may take up to 2 weeks - 1 month depending on complexity, queue, health, work, or personal matters.
- I will keep you updated if delays occur.
- If you wish to skip the Queue and be Priority, the fee will be 10€. You will have to Directly Message me or state in the Request forms that you wish for a Rush Fee.

Intellectual Property Rights

- I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.I may use the artwork to:
- Promote myself and my services.
- Post on social media and in my portfolio.
- Create prints/merchandise (for fanart commissions only).Exceptions:- If an NDA was purchased, the artwork will not be posted or used for promotional purposes.

Refunds

- I may cancel and refund a commission at any time.
- You may cancel before payment is made.
- Once payment is received, refunds are not available.
- Chargebacks are strictly prohibited.Filing a chargeback will:- Forfeit your rights to use the artwork.
- Place you on a blacklist.
- Allow me to resell or reuse the artwork as I see fit.

Commissioner Rights

You may:
- Use the artwork for personal purposes only (unless commercial rights are purchased).
- Print the art for yourself.
- Post it on Social Media with credit to me "@sunihae404".You may NOT:
- Use the artwork commercially without permission.
- Claim the artwork as your own or fail to credit me.
- Remove signatures/watermarks.
- Resell or redistribute the artwork.
- Modify the artwork without my consent.
- Use artwork purchased for Personal Use in merch, streaming, or commercial projects.

Final Agreement

By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.

Instructions

1. Read through the Terms and Conditions, Commission Details and Prices carefully.2. Answer the Google form to send your commission details and contact information, or order a commission through Ko-fi. Further communication can be done through social media messages/email.3. Once I have approved your commission, I will send a sketch. A 50% upfront payment is required to begin work. The remaining 50% is due before final delivery of the artwork. Please patiently wait for your commission to finish.4. Estimated turn around time is 2 weeks - 1 month. Feel free to check Trello for my work queue and updates.5. I will send proof of the finished commission, and the PNG files will be sent after you have paid your remaining balance.
